New Details on 10-Year-Old Giving Birth; Accused Rapist Cries During Not-Guilty Plea

Channel 3 has obtained new details in the case of a 10-year-old Fremont County girl who gave birth on May 3.

The 10-year-old girl was apparently raped while living with her mother, Isabel Chasarez, and her mother's boyfriend, Guadelupe Gutierrez-Juarez. Both of them are being charged in connection with the case.

There were also three other children living at the home. One girl is older than the 10-year-old and two are younger.

The 10-year-old and her older sister are from a previous relationship of Chasarez. All of the children are now in state custody.

Both Chasarez and Gutierrez-Juarez were very emotional Tuesday in court as they pleaded not-guilty.

37-year-old Guadelupe Gutierrez-Juarez hardly looked up at all Tuesday as he waived his right to a preliminary hearing in the Fremont County magistrate court.

A few hours later, he was arraigned in district court and appeared to be crying during most of the proceedings. An interpretor translated for him and the only words he spoke were 'not guilty.'

Gutierrez-Juarez is facing three rape charges after allegedly raping the 10-year-old at least twice last year and once in January.

The girls mother, 27-year-old Isabel Chasarez, was also visibly upset Tuesday and at times sobbed as Judge Brent Moss explained the one felony count of child endangerment she is facing. Chasarez is accused of failing to obtain prenatal care for her 10-year-old between January 1st and April 28th of this year.

Speaking through an interpreter, Chasarez pleaded not guilty.

When police learned the 10-year-old was pregnant, they acted quickly and arrested Gutierrez-Juarez within hours. They were worried he might have fled with the girl to Mexico.

The 10-year-old and her baby are both in custody of the state. Authorities say they are doing well.
