After following All American Towing for several days and nights, we wanted to see what the owner had to say about the students accusations.
Nate Eaton, Channel 3: "A lot of people say that you do predatory practices. Do you have anything to say to that?"
Darren Helm, All American Towing: "Can you shut your camera off for a second?"
Eaton: "No, we're hoping to get a comment from you."
Helm: "Let me talk to you first about what you want to talk about and I'll see if I want to be in your interview."
Eaton: "Is there something you want to hide that's not on camera?"
Helm: "No it's just that I'd like to talk to you first so if you could please shut your camera off or get off my property and I'll talk to you."
Eaton: "And then will you talk on camera if we turn it off?"
Helm: "I'll talk to you first."
Eaton: "And then will you talk on camera?"
Helm: "You need to leave please."
Eaton: "So you don't want to comment about anything?"
Helm: "No you just don't come up to somebody and start filming them."
Eaton: "Is it like going up to somebody and towing them?"
Helm: "You need to leave please."
All American wouldn't talk to us on camera and neither would several apartment owners. They know a lot of students don't like the towing policy. But the owner of Sunrise Village Apartments says towing is absolutely needed.
Heather Johnson, Sunrise Village Apartments Owner: "The students come and park here illegally and go up to class and then there's no parking spaces for our residents so we have to tow them in order to keep the spaces for our residents."
Some students say there needs to be more management involvement…that the tow truck can only take a vehicle if the manager says it's okay.
Barney Towing agrees with that.
D.J. Barney, Barney Towing & Recovery: "Managers either need to do it themselves or pay somebody else to monitor it but having somebody that is providing a service free of charge and charging the students where their revenue is based on how many car they towed…there's a little bit of a conflict of interest."
Stephanie Barclay, BYUI Student: "When the person choosing to the tow the student is also the person who gets paid for towing the student, no matter how good of a person he is, corruption fosters in a situation like that."
A few weeks ago a heated meeting was held at the Rexburg City Hall about booting and towing.
Right now the city council is considering changing the ordinance to make it so a tow company could only take a car if a manager or someone with an apartment called them and specifically asked the company to tow it.
From our observations, All American Towing is doing nothing illegal…and if a student feels that he or she was towed illegally, they can take the case to court.
