HAILEY, Idaho (AP) — A 56-year-old southern Idaho businessman pleaded guilty to a misdemeanor voter fraud charge after acknowledging he tried to vote twice in the November 2008 election.

Walter Coiner, a resident of Ketchum and owner of Hollyberry Nursery in Hansen, pleaded guilty to attempting to vote when not qualified.

He was originally charged with felony illegal voting, an offense punishable in Idaho by up to five years in prison, the Idaho Mountain Express reported.

Instead, Coiner must serve a term of one-year unsupervised probation. Blaine County Magistrate Judge Jason Walker also required him to perform 40 hours of community service and Coiner must pay $375 in fines and court costs.

Deputy Prosecuting Attorney Matt Fredback said Coiner has no prior criminal record and was cooperative with authorities. Coiner didn't return a phone call from The Associated Press.

This week Gov. Otter signed a bill requiring Idaho to sue the federal government if Congress passes health care reform. What's your response to this?

  • It's great to see Idaho taking the lead on this. Someone has to stand up to what's happening in Washington.
  • We can't afford to pay for education in Idaho, but we're going to spend tax dollars to sue the feds? Ridiculous.
  • Not sure.
