ICP ticket refund run-around continues

IDAHO FALLS - The run-around continues and fans are only getting more frustrated.

Ken Whitmore bought four tickets and is waiting for his $100 refund. It's now past the deadline and he has not seen any money.

"Nothing. Same thing same results just nothing nothing nothing. If you owe somebody some money you gotta pay it," he says.

James Slavens, the concert promoter, was supposed to give CD World the money to refund customers after the concert was cancelled, but he has only returned a fraction of it.

"There is no sense in extending this, and bringing me this much money, and then this much and then this much, and then running out of money, because I have people coming down from Jackson Hole, Shelley, Pocatello, trying to get the money because they heard there's money here and then the money is gone," says Katrina Larsen, owner of CD World.

Slavens sent his sister to give CD World a check Tuesday night, but it was too late to get the check cashed and past his promised due date.

Larsen says she asked Slavens sister to go cash the check and come back with the money and that she could do the refunds.

"She apparently called her brother and never came back. I also told her that they could come down here in the morning and do all the refund for all the public," says Larsen.

CD World has yet to see him or the money. Instead Slavens sent an email to CD World directing them to have all fans call the number on the Red Tie Concerts website. The message on the website prompts the ticket holder to send the tickets to Red Tie Concerts at a P.O. Box.

Channel 3 Eyewitness News called the Better Business Bureau to make sure it was safe for you to mail in your tickets. The BBB says they strongly suggest you do not because there is no way to track or prove they were ever received.

"As of right now, I do not trust him to even mail them," says Jason Sumaya, another ticket holder.

People who bought the tickets say they don't blame CD World for this mess, and they just want the promoter to pay them what they're owed.

The Bonneville County Sheriff's Office may launch an investigation into this case, if this continues.

Slavens did call us after this story ran earlier. He tells Eyewitness News that he has every intention to refund all the ticket holders. He also says in order to feel assured about mailing your tickets back, you can use certified mail. Certified mail will require Slavens to sign that he received the tickets.

Slavens emailed Channel 3 Eyewitness News the following information:

"Everyone deserves a refund and will receive a full refund. It is important that all those seeking refunds for the cancelled ICP show, and have not yet received a refund thru CD World, mail their tickets (and receipt if their tickets say 'COMP') to:

A refund check will be issued to the return address on the envelope within ten business days. It is important that sent tickets have a postmark date no later than Friday (12/18)."
